The Gilbert Hyatt Saga
BY SEAN LYNCH · MAY 16, 2022
Gilbert Hyatt filed hundreds of patent applications, and decades later many of them were still pending while he fought the USPTO over how they were being handled. He alleged the agency had effectively organized itself around keeping his applications from issuing — one of the strangest sustained standoffs in modern patent history.
Most prosecution disputes are far less dramatic, but the underlying experience is familiar: an applicant who believes the office is not engaging with the merits. Lynch LLP works with inventors and companies on prosecution strategy and on disputes with the USPTO over how an application is being examined. How any given matter plays out depends on its own record.
